2. General provisions
Matters not regulated here are governed by Hungarian law, in particular Act V of 2013 on the Civil Code, Act CVIII of 2001 on electronic commerce services, and Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses.
The contract is concluded in Hungarian, is not considered a written contract, is not filed by the Seller and is not subsequently accessible.
The Seller reserves the right to amend these Terms. Amendments take effect on publication and do not affect orders already placed.
3. Products
The webshop sells whole-bean and ground coffee, coffee capsules, brewing equipment and machines, and merchandise.
Prices are shown in Hungarian forint (HUF) and include VAT. Prices do not include the delivery fee, which is displayed separately at checkout before the order is finalised.
Coffee is roasted to order, so the pack sizes shown on a product page depend on the current roasting schedule.
If, despite all care, an incorrect price is displayed — in particular an obviously erroneous price such as HUF 0 or one significantly different from the product’s well-known value — the Seller is not obliged to sell at that price, but may offer performance at the correct price, in which case you may withdraw from the purchase.
4. Placing an order
- Add the product to your basket.
- At checkout, enter your billing and delivery details and choose a delivery and payment method.
- Before finalising, you can review and amend your details and the contents of your basket.
- Pressing “Send order” constitutes an offer carrying an obligation to pay.
An automatic acknowledgement email is sent after the order is placed. This confirms receipt of the order; it is not acceptance of your offer. The contract comes into existence with the Seller’s separate email confirming fulfilment.
If no confirmation arrives within 48 hours, you are released from your offer.
5. Payment
- Card payment (SimplePay): online card payments are processed through SimplePay, operated by OTP Mobil Kft. Card details are never disclosed to the Seller.
Invoices are issued electronically and sent by email. You accept this by placing an order.
SimplePay data transfer declaration
I acknowledge that the following personal data of mine, stored in the user database of bagira.coffee by the data controller TTG Gastro Kft. (1074 Budapest, Dob utca 25. Fszt. 2.), will be transferred to OTP Mobil Kft. as data processor: name, delivery address, phone number, email address. The nature and purpose of the processing carried out by the data processor can be reviewed in the SimplePay Privacy Notice: https://simplepay.hu/adatkezelesi-tajekoztatok/
6. Delivery and collection
Orders are dispatched within three working days. For quantities above 5 kg the dispatch date is agreed individually, as those are roasted specifically for you.
- GLS home delivery — 1–3 working days, HUF 1,462
- Parcel point and parcel locker (GLS CsomagPont, Foxpost) — 1–3 working days, the current fee is shown in the basket
- Personal collection — 1074 Budapest, Dob utca 25., during opening hours, free of charge. We email you when the order is ready and hold it for 14 days.
Delivery is free on orders above HUF 21,600. The exact fee is always displayed at checkout before payment.
Please check the parcel in the courier’s presence. If it is damaged, ask for a report and do not accept it; without a report the carrier may not accept a later claim.
7. Right of withdrawal
If you are a consumer, under Government Decree 45/2014 (II. 26.) you may withdraw from the contract within 14 calendar days of receiving the product, without giving reasons.
It is enough to notify us within the 14-day period — email info@bagira.coffee with your order number, or use the model form below.
Return the product within 14 days of giving notice to 2142 Nagytarcsa, Felső Ipari körút 2/A, Hungary. The direct cost of return is borne by you. We cannot accept parcels sent cash on delivery.
We refund the price of the product and the cost of outbound delivery within 14 days of learning of your withdrawal, using the same payment method you used. We may withhold the refund until we have received the product back or you have provided credible proof of returning it.
When the right of withdrawal does not apply
Under Section 29 of Government Decree 45/2014 (II. 26.), the right of withdrawal does not apply to sealed goods which cannot be returned after opening for health-protection or hygiene reasons. Coffee is a foodstuff: we therefore cannot take back coffee in opened packaging. Unopened products in intact original packaging are of course accepted.
For machines and equipment, return requires intact packaging and complete accessories.
Model withdrawal form
(Complete and return only if you wish to withdraw from the contract.)

8. Warranty rights
Supplier’s warranty (kellékszavatosság)
In the case of defective performance you may enforce a supplier’s warranty claim under the Civil Code. You may request repair or replacement, unless the chosen remedy is impossible or would involve disproportionate additional cost. Failing that, you may request a proportionate reduction of the price or withdraw from the contract.
You must report the defect without delay, and at the latest within two months of discovering it. No supplier’s warranty claim may be enforced more than two years after performance. Within one year of performance, reporting the defect is the only condition; after one year you must prove that the defect existed at the time of performance.
Product warranty (termékszavatosság)
For a defect in a movable item you may choose between a supplier’s warranty and a product warranty claim. Under a product warranty you may only request repair or replacement, directly from the manufacturer. A product is defective if it does not meet the quality requirements in force when it was placed on the market, or lacks the properties described by the manufacturer. A product warranty claim may be enforced within two years of the product being placed on the market.
Guarantee (jótállás)
Durable consumer goods covered by Government Decree 151/2003 (IX. 22.) — for example certain coffee machines — carry a mandatory guarantee. Its duration is 1, 2 or 3 years depending on the purchase price. The guarantee does not affect your statutory rights.
No guarantee applies to foodstuffs (coffee); the best-before date is shown on the packaging.
9. Complaints and remedies
You may submit a complaint at info@bagira.coffee or on +36 70 786 3670. Written complaints are answered on the merits within 30 days.
If you disagree with the handling of your complaint, you may turn to:
- Consumer protection authority: the county or metropolitan government office competent for your residence.
- Conciliation board: the board competent for the Seller’s seat is the Budapest Conciliation Board (1016 Budapest, Krisztina krt. 99. III/310., email: bekelteto.testulet@bkik.hu). The Seller has a duty to cooperate in conciliation board proceedings.
- Online dispute resolution (ODR): https://ec.europa.eu/odr
- Court: the dispute may also be settled in court.
10. Data protection
Information on the processing of personal data is set out in our Privacy Policy.
11. Miscellaneous
The content of the webshop is protected by copyright. It may not be used, in whole or in part, without the Seller’s prior written consent.
The Seller is not liable for delays or faults arising from causes beyond its control (for example a failure of the internet connection, or force majeure).
